Jack Smith's 'Jan. 6' Indictment of Donald Trump is an Escalatory Strike on the First Amendment and Wrongthinking Americans
The fraud comes in DOJ's claims it is 'defending democracy' by interfering in elections and 'pursuing justice' by eviscerating our fundamental rights
Trump Jan. 6 Indictment is Latest Strike in the War on Wrongthink
The latest lawfare missile lobbed at Republican presidential frontrunner Donald Trump by his successor and chief opponent Joe Biden, via Special Counsel Jack Smith's “January 6” indictment, should be seen as an escalatory strike on the American people in the ongoing War on Wrongthink.
Having previously colluded with social media companies to censor disfavored opinions about the 2020 election, our ruling class, led by the Justice Department, now wants to criminalize such Wrongthink and deter those who would defend the Wrongthinkers — in 2024 and beyond.
As I detail in a new piece at Newsweek, Special Counsel Smith does so by reading President Trump's mind, claiming that despite what he has always maintained, Trump didn't really believe the election was stolen from him; that his election challenges were therefore fraudulent; and that thus he must be charged under whatever statutes can be twisted to fit the thought crimes.
That is, the “novel” case rests on the premise that Trump knew he lost, so everything he did to try and win was criminal.
As I explain in the piece, irrespective of whether this case moves forward — likely in the most hostile venue and in front of perhaps the most hostile judge imaginable — immense damage to First Amendment protected speech, and the right to petition government for redress of grievances, has already been done.
